HERCode — Terms of Service

1. Agreement to These Terms

These Terms of Service govern your use of the HERCode mobile application, website, content, features, and related services, together called the “Service.”

By creating an account or using HERCode, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account or use HERCode.

HERCode is intended only for adults. If you are under 18, you must not create an account or use the Service.

3. Your Account

You agree to provide accurate information and keep your login details secure. You are responsible for activity carried out through your account.

You may not impersonate another person, create fraudulent accounts, commercially share an account, or attempt to access another user’s information.

Contact hello@hercode.ai if you believe your account has been accessed without permission.

4. What HERCode Provides

HERCode is a self-development and emotional wellbeing platform. Features may include:

• archetype and self-reflection exercises;
• communication and situation analysis;
• daily reflections and journaling;
• relationship profiles and relationship insights;
• boundary tracking;
• suggested communication scripts;
• weekly summaries and monthly reports;
• trends, saved insights, and growth timelines; and
• AI-powered features and automated systems.

HERCode is designed for educational, informational, and personal-development purposes.

HERCode does not provide therapy, counseling, psychological treatment, medical care, diagnosis, legal advice, financial advice, or crisis support.

Using HERCode does not create a therapist-client, doctor-patient, counselor-client, lawyer-client, or other professional relationship.

You remain responsible for decisions or actions you take based on information provided through HERCode.

5. AI-Powered Features and Automated Content

HERCode may use automated systems and AI-powered features to generate insights, summaries, scripts, questions, recommendations, classifications, and other educational content.

Automated outputs may be inaccurate, incomplete, repetitive, or unsuitable for your circumstances. They may misunderstand context, relationships, intentions, emotions, or communication.

Use your own judgment and seek qualified professional support where appropriate. Do not rely on HERCode as the sole basis for important health, safety, legal, financial, relationship, or life decisions.

We may update or replace the technologies used to provide automated features. Material changes to how personal data is processed will be explained in the Privacy Policy.

6. Crisis and Emergency Situations

HERCode is not an emergency or crisis service and does not monitor users for emergencies.

If you are experiencing thoughts of self-harm or suicide, abuse, violence, immediate danger, or another emergency, contact local emergency services or an appropriate qualified crisis-support provider immediately.

Do not wait for a response from HERCode in an emergency.

7. Free and Premium Plans

HERCode may offer a free plan and a paid HERCode Premium subscription.

Features, limits, prices, currencies, trial periods, and promotions may vary by platform, country, or account and will be shown before purchase.

Subscriptions purchased through Google Play or the Apple App Store are processed and managed by the relevant store. HERCode does not receive your full payment-card details.

Subscriptions may renew automatically unless cancelled through your app-store account before the renewal date. Deleting the app or your HERCode account does not automatically cancel an app-store subscription.

Refunds, billing disputes, cancellations, and applicable withdrawal rights are handled according to the relevant app store’s policies and applicable law.

We may change Premium features or future prices. Changes will not alter a billing period already paid for except where permitted by law or platform rules.

8. Trials, Promotions, and Referrals

HERCode may offer trials, referral rewards, bonus Premium days, or other promotions.

The conditions, eligibility requirements, duration, and limits will be shown when an offer is available.

You may not use self-referrals, fake accounts, automated sign-ups, spam, resale, misleading promotion, or other abusive methods.

We may withhold or remove rewards obtained through abuse, fraud, or technical error. We may modify or end a promotion or referral programme, subject to applicable law.

9. Your Content

You may provide content including:

• quiz answers;
• reflections and journal entries;
• boundary logs;
• relationship information;
• messages and communication examples;
• screenshots, images, or files;
• voice recordings or transcriptions, if enabled;
• saved notes, scripts, and feedback.

You retain ownership of your content.

You give HERCode a limited, non-exclusive licence to host, store, process, reproduce, and display your content only as necessary to operate, secure, personalize, and improve the Service, comply with the law, and provide requested features.

You confirm that you have the right to submit your content.

When uploading conversations, screenshots, or information involving another person, you are responsible for respecting their privacy and applicable law.

Do not submit content that is unlawful, threatening, abusive, hateful, sexually exploitative, infringing, fraudulent, or that unlawfully reveals another person’s private information.

10. Acceptable Use

You must not:

• interfere with the Service or its security;
• access or attempt to access another user’s account or data;
• bypass feature limits, access controls, or payment systems;
• reverse engineer, scrape, copy, or commercially exploit the Service except where permitted by law;
• upload malicious code;
• use HERCode to harass, threaten, manipulate, impersonate, or unlawfully monitor another person;
• use HERCode as a substitute for licensed professional services provided to third parties; or
• use the Service for unlawful purposes.

We may restrict or suspend access when reasonably necessary to protect users, the Service, or legal compliance.

11. HERCode Intellectual Property

HERCode’s software, branding, visual designs, archetypes, questions, educational frameworks, templates, written content, and other materials are owned by HERCode or used under licence.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Service for personal purposes under these Terms.

You may not copy, sell, license, distribute, modify, or create commercial products from HERCode materials without written permission.

12. Third-Party Services

HERCode may rely on third-party services such as Firebase, Google Play, the Apple App Store, cloud infrastructure, email providers, and other technical services.

Your use of third-party services may also be governed by their terms and privacy policies. HERCode is not responsible for services, websites, or content controlled by third parties.

13. Account Deletion and Data Export

You may request account deletion through HERCode’s settings or by contacting hello@hercode.ai.

Account deletion and data retention are handled as described in the Privacy Policy. Some information may be retained where necessary for legal obligations, security, fraud prevention, dispute resolution, or app-store billing records.

The available in-app export may contain only the data currently supported by the export feature. You may contact hello@hercode.ai regarding a broader access or portability request.

Deleting your HERCode account does not cancel an app-store subscription. Subscriptions must be cancelled separately through Google Play or the Apple App Store.

14. Suspension and Termination

You may stop using HERCode at any time.

We may suspend or terminate access if we reasonably believe that you:

• seriously or repeatedly violated these Terms;
• used the Service unlawfully;
• created a security or safety risk;
• engaged in fraud or abuse; or
• failed to pay a valid subscription charge.

Where appropriate and legally required, we will provide notice or an opportunity to address the issue.

Terms concerning intellectual property, liability, user content, disputes, and other provisions that should survive will continue after termination.

15. Availability and Disclaimers

HERCode is provided “as is” and “as available.”

We do not guarantee that the Service will always be available, uninterrupted, error-free, secure, or suitable for every user.

We do not guarantee that automated insights will be accurate or that using HERCode will produce a particular emotional, relationship, wellbeing, or personal-development result.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by law, HERCode and its operator will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Service, including loss of data, income, opportunity, goodwill, or expected results.

Where liability cannot be excluded, HERCode’s total liability relating to the Service will not exceed the greater of:

• the amount you paid for HERCode during the 12 months before the claim; or
• CHF 50.

This limitation does not apply where liability cannot legally be limited, including liability caused by intentional misconduct or gross negligence where applicable.

17. Changes to the Service or Terms

We may update HERCode and these Terms as the Service develops.

If a change is material, we will provide reasonable notice through the app, by email, or another appropriate method. Where required by law, we will request consent.

The current version and effective date will be available through HERCode. If you do not agree with updated Terms, you must stop using the Service.

18. Governing Law and Disputes

These Terms are governed by Swiss law.

Courts in Zurich, Switzerland have jurisdiction, except where mandatory consumer-protection law gives you the right to bring a claim in another court or under another governing law.

Before starting formal proceedings, you are encouraged to contact hello@hercode.ai so we can try to resolve the matter.
